Firm suing Pequots taking case to Supreme Court

HARTFORD — The company suing the Eastern Pequots for breach of contract is taking its case straight to the state Supreme Court.

Almagamated Industries Inc. is bypassing the state appellate court, company officials said Monday. The company filed a motion Aug. 26 to move the case to the Supreme Court after the Eastern Pequots in May were denied all motions to dismiss the suit. Since that May decision, the Eastern Pequots filed an appeal in appellate court.

In the original lawsuit filed in July 2003, Amalgamated alleges the tribe unlawfully abandoned a business partnership with the company after it merged with the Paucatuck Eastern Pequots, Amalgamated’s original business partner.

The two tribes became known as the Historic Eastern Pequots.

Amalagamated claims it had a 10-year partnership with the Paucatucks and advanced them $10 million and expertise toward gaining federal recognition. But the tribe broke the standing contract in favor of the Eastern’s financial backers, Rosow Group, after the merger, it claims.

The tribe received federal recognition in 2002, but that status was vacated May 13.
